ENCHANTED VALLEY SUBDIVION PROPERTY OWNERS’ ASSOCIATION
PARK AND LAKE USE RULES
The following Park and Lake Use Rules apply to the Common Area Boat Ramp and Park (“Park”) along Lake LBJ in the Enchanted Valley Subdivision.
1. Lake Access
All members in good standing of the Enchanted Valley Subdivision Property Owners’ Association, Inc. (“EVSPOA”), and their guests when accompanied by said member, subject to these Rules and other posted Rules and Regulations, shall be allowed access to and the usage of the Lake through the Park. Access to and the usage of the Lake shall be for recreational purposes only.*
2. Park Usage
All members in good standing of the EVSPOA, and their guests when accompanied by said member, subject to these Rules and other posted Rules and Regulations, shall be allowed access to and the usage of the Park, including the boat ramp, dock and picnic area. Access to and the usage of the Park shall be for recreational purposes only.*
*No person who is not a member in good standing of EVSPOA (or their guests), shall be allowed access to the Lake through the Park, nor usage of the Park. “Members in Good Standing” are members of the EVSPOA who have paid all current dues, assessments and fees and are not being pursued for any deed restriction violations. The Park is a private area for the use and enjoyment of members in good standing with the EVSPOA; trespassers shall be prohibited from access and use of Park.
3. Bank
No construction or landscaping shall be done by any Member at the Park and surrounding
Common Area without prior approval from the EVSPOA. Any damage to the trees, land, boat ramp, bank and/or bulkhead shall be the responsibility of the person who causes the damage if an Owner, and if not an Owner shall be the responsibility of the Owner for any guests, invitees, licensees, and/or family members who cause the damage.
4. Swimming
SWIMMING, WADING, OR ANY OTHER WATER CONTACT WILL BE AT YOUR OWN RISK. The area contains algae and other water plants which can be a swimming hazard and which create an ideal habitat for snakes.
5. Garbage and Refuse Disposal
Trash, garbage or other waste shall not be disposed of in or around the Park or Lake.
6. Fishing
Fishing is permitted at your own risk.
7. Hunting
HUNTING AT THE PARK IS STRICTLY PROHIBITED, AND THE DISCHARGE OF ANY FIREARM FOR ANY PURPOSE IS PROHIBITED.
8. Pumps
No manual, electric or gas powered pumps will be allowed to draw Lake water for the private use of members from the Park.
9. Nuisances
No noxious or offensive activity shall be permitted upon the Park, nor shall anything be done
thereon which may be or may become an annoyance to other persons using the Park. Any action or use of the Park, not specifically mentioned but which is deemed by the Board of Directors to be injurious or hazardous, shall be prohibited.
10. Enforcement
Enforcement of these rules and regulations shall be by the Board of Directors of the EVSPOA or its assigns. The Board, at its discretion, may delegate the power to interpret and the duty to enforce these rules and regulations to a duly appointed committee.
11. Amendment
These rules and regulations may be amended from time to time by the Board of Directors.
Amendments shall be made available to members in a manner determined by the Board.
12. Alcohol Consumption
No person shall use the Park while consuming or while under the influence of drugs or alcoholic beverages. Alcholic Beverages are prohibited in the Park.
13. Fines
The Association shall have the right to impose reasonable fines for violations and prohibited use of the Park by those who violate Rules, subject to notice and a right to a hearing.
14. Indemnity
Each Owner and occupant of any Lot and each Owner and occupant on behalf of their tenant,
guest and invitee of an Owner, as applicable, acknowledges and understands that the EVSPOA, its Board of Directors, or any successor are not insurers and that each Owner
and occupant of any Lot and each tenant, guest and invitee of any Owner assumes all risks for loss or damage to persons, and further acknowledges that the EVSPOA, its Board of Directors, or any successor have made no representations or warranties nor has any
Owner, occupant, tenant, guest or invitee relied upon any representations or warranties, expressed or implied as to the safety of the Park or the Lake. Each Owner and occupant of any Lot and each Owner and occupant on behalf of their tenant, guest and invitee of an Owner shall indemnify and hold harmless the EVSPOA, its Board of Directors, or any successor for all loss or damage to persons who use the Park, the Lake and the surrounding Common Area.
